This website (the “Site”) is operated by Stefanie Van Elmpt trading as Moonrise Growers, ABN 70 168 849 893 (“Moonrise Growers”, “we”, “us” or “our”). Moonrise Growers grows and sells dahlias, ranunculus, chrysanthemums and other seasonal cut flowers, plants and bunches, by retail, wholesale and subscription, both through this Site and by other means such as market stalls and direct arrangement.
These Terms of Service (the “Terms”) set out the conditions on which we make the Site and our products and services (together, the “Service”) available to you. By visiting the Site or purchasing anything from us, you accept these Terms in full. If you do not agree with any part of these Terms, please do not use the Site or purchase from us.
These Terms apply to everyone who accesses or uses the Site, including browsers, customers, wholesale account holders, subscribers and anyone submitting content to us.
We may update these Terms from time to time by posting a revised version on the Site. The version posted on the Site at any given time is the version that applies, and it is your responsibility to check back periodically. Continuing to use the Site after an update takes effect means you accept the changes.
Our online store is hosted on the Shopify platform, which provides the underlying e-commerce infrastructure that lets us sell our products and services to you.
1. Use of the Site
By using the Site, you confirm that you are at least 18 years old, or that you are using the Site with the consent of a parent or guardian.
You must not use the Site or our products for any unlawful purpose, and you must comply with all laws that apply to your use of the Site, including intellectual property laws.
You must not upload, transmit or introduce any virus, worm or other malicious or destructive code to the Site.
Breaching any part of these Terms may result in immediate suspension or termination of your access to the Service.
2. General Conditions
We may decline to provide the Service to anyone, for any reason, at any time.
Information you submit through the Site (other than payment card details) may be transmitted over public networks in a form that is not encrypted, and may need to be adapted to meet the technical requirements of connecting networks or devices. Payment card details are encrypted in transit.
You must not reproduce, duplicate, copy, sell, resell or otherwise exploit any part of the Service, or access to it, without our prior written permission.
Headings in these Terms are for convenience only and do not affect their interpretation.
3. Accuracy of Site Content
We try to keep the information on the Site accurate and current, but we do not guarantee that everything on the Site is accurate, complete or up to date. Content on the Site is provided for general information only, and you should not rely on it as the sole basis for any decision - including decisions about growing conditions, plant care, or suitability of a product for your purposes - without checking other reliable sources.
The Site may include historical information from time to time, which is provided for reference only and may no longer be current. We may change the content of the Site at any time without notice, and we are not obliged to update it.
4. Changes to the Service and Pricing
Prices for our flowers, plants, bunches and other products may change without notice, including for seasonal or wholesale pricing.
We may modify, suspend or discontinue any part of the Service at any time without notice, and we will not be liable to you or any third party for doing so.
5. Products, Orders and Subscriptions
Cut flowers, bunches and plants are living, seasonal products. Availability, appearance, colour, size and bloom stage will vary by season, weather and growing conditions, and we cannot guarantee that any particular variety will be available at a given time.
We make reasonable efforts to display accurate photos and descriptions of our products, but actual blooms will vary naturally from photos shown on the Site, and screen colour reproduction may also differ from the actual product.
Where we agree an ongoing or standing order with you (for example, a recurring bunch arrangement), the terms of that arrangement - including frequency, pricing and how to cancel or pause it - will be as agreed between us directly, and these Terms apply in addition to that agreement.
Because of the perishable nature of our products, please refer to our Refund Policy for how returns, refunds, replacements and quality issues are handled.
We may limit the quantities of any product or service, restrict sales to particular regions, or discontinue a product, at our discretion and without notice. Any offer made on the Site is void where prohibited by law.
We do not warrant that any product or service will meet your particular expectations, beyond what is required by the Australian Consumer Law.
6. Plant Sales, Biosecurity and Interstate Shipping
Some products, such as dahlia tubers, ranunculus corms and other live plant material, are subject to interstate quarantine and biosecurity requirements (including under frameworks such as the Tasmanian, South Australian, Western Australian and other relevant state biosecurity import conditions). Where these requirements apply, it is your responsibility to confirm that you are permitted to receive that plant material in your state or territory before ordering.
We will take reasonable steps to package and label live plant orders in line with the accreditation and conditions that apply to us, but we are not responsible for delays, rejections or destruction of goods by biosecurity authorities, or for changes to import conditions that occur after your order is placed.
7. Billing and Account Information
We may refuse, limit or cancel any order, including orders that appear to use the same account, payment method or address as another order, or that we reasonably believe are placed by a reseller or distributor rather than an end customer, except where you hold an agreed wholesale account with us.
You agree to give us current, complete and accurate information when you order or set up an account, and to keep your account details (including your email address and payment details) up to date so that we can process your order and contact you if needed.

8. Third-Party Tools and Links
We may give you access to third-party tools (for example, payment, shipping or marketing tools) that we do not control. Such tools are provided “as is”, without any warranty from us, and your use of them is at your own risk and subject to that third party’s own terms.
The Site may also contain links to third-party websites that are not operated by us. We are not responsible for the content, accuracy or practices of any third-party site, and including a link does not mean we endorse it.
9. Comments and Submissions
If you send us comments, photos, reviews, suggestions or other material, you agree that we may use, reproduce and share that material (for example, on our Site or social media) without compensation to you, unless we agree otherwise in writing. We are not obliged to keep any submission confidential or to respond to it.
You must not submit anything unlawful, defamatory, obscene, or that infringes someone else’s rights, and you are responsible for the accuracy of anything you submit.
10. Personal Information
Any personal information you provide through the Site is handled in accordance with our Privacy Policy.
11. Errors and Corrections
The Site may occasionally contain typographical errors or inaccuracies relating to descriptions, pricing, availability or shipping. We may correct these, and may cancel an affected order, at any time without prior notice, even after you have submitted that order.
12. Prohibited Uses
You must not use the Site to: break any law; infringe our or anyone else’s intellectual property rights; harass, abuse or discriminate against any person; submit false or misleading information; upload malicious code; collect other users’ personal information without consent; spam, scrape or crawl the Site; or interfere with the security of the Site. We may suspend or end your access to the Service if you breach this section.
13. Disclaimer and Limitation of Liability
We do not guarantee that the Site or Service will be uninterrupted, secure or error-free, and your use of the Service is at your own risk. Except for any guarantees that cannot be excluded under the Australian Consumer Law, the Service and our products are provided on an “as is” and “as available” basis, without warranties of any kind.
To the maximum extent permitted by law, Moonrise Growers and our officers, employees, contractors and suppliers will not be liable for any indirect, incidental, special or consequential loss (including loss of profits, revenue, savings or data) arising from your use of the Service, even if we have been advised of the possibility of such loss. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
14. Indemnity
You agree to indemnify Moonrise Growers and our officers, employees, contractors and suppliers against any claim, loss or expense (including reasonable legal costs) arising from your breach of these Terms or your misuse of the Service, to the extent permitted by law.
15. Severability
If any part of these Terms is found to be unlawful or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining provisions will continue to apply.
16. Termination
Either of us may stop the arrangement under these Terms at any time - you, by ceasing to use the Site; us, where we reasonably believe you have breached these Terms, by suspending or ending your access. Obligations that, by their nature, should survive termination (such as payment for orders already placed) will continue to apply.
17. Entire Agreement
These Terms, together with any policies referred to in them (such as our Refund Policy and Privacy Policy), make up the entire agreement between you and us about your use of the Service, and replace any earlier agreements or understandings on that subject. Our not enforcing a particular provision on one occasion does not waive our right to enforce it later.
18. Governing Law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
19. Changes to These Terms
We may update these Terms at any time by posting a new version on the Site. Please check this page from time to time - continuing to use the Site after a change takes effect means you accept the updated Terms.
