These terms (“Agreement”) apply, in addition to our general Terms of Service and Refund Policy, to your purchase of dahlia tubers, dahlia plants, chrysanthemum plants, ranunculus plugs, corms and seeds, and any other live plant material (together, “Plant Material”) from Stefanie Van Elmpt trading as Moonrise Growers, ABN 70 168 849 893 (“we”, “us”, “our”). By placing an order for Plant Material, you (“you”, the “customer”) agree to be bound by this Agreement. Where this Agreement conflicts with our general Terms of Service or Refund Policy on a matter relating specifically to Plant Material, this Agreement applies.
1. Ordering
1.1 Description and condition
Unless stated otherwise, each listing is for one item of Plant Material (for example, one dahlia tuber, one dahlia plant, or one ranunculus corm or plug). We aim to supply tubers and corms with a visible eye and an intact neck and body, and plants in a condition that a reasonable person would expect to grow on with appropriate care.
1.2 Availability
We grow on a small scale, so stock of some varieties is limited and may sell out quickly. All orders are subject to availability. If an item in your order becomes unavailable before dispatch we will refund that part of your order. Items in your cart are not reserved or confirmed as yours until checkout is fully complete.
1.3 Pricing
Prices for Plant Material are in Australian dollars and do not include postage and handling, which is charged separately as set out in clause 2.4. We may change prices at any time without notice, but a price change will not affect an order you have already placed and had confirmed.
1.4 Variety and household limits
From time to time we may limit the number of a particular variety that can be purchased per household or shipping address. Limits will be stated on the relevant product listing. If an order exceeds a stated limit, we will refund the excess quantity. If you believe you have exceeded a limit in error, please email us at hello@moonrisegrowers.com.au before we process the refund so we can assist.
1.5 Order confirmation
You will receive an order confirmation by email once your order is placed and paid. Please check this confirmation and contact us promptly if you believe there is an error - particularly in your shipping address or contact details, since it is your responsibility to ensure these are correct.
2. Shipping
2.1 Where we ship
We currently ship Plant Material within Australia only. Due to interstate quarantine and biosecurity restrictions, we are unable to ship Plant Material to Tasmania, Western Australia or the Northern Territory. It is your responsibility to check that you are permitted to receive the Plant Material you are ordering at your address before you order; we may cancel and refund an order if we identify a quarantine or biosecurity restriction that prevents us from shipping it to you.
2.2 Dispatch timing
Plant Material is generally dispatched via Australia Post once it is ready - for dahlia tubers, this is usually around September to October, once eyes are visible. Dispatch dates are approximate and may be affected by factors outside our control, including weather and carrier delays.
2.3 Combined shipping
We offer combined shipping for orders placed within the same weekly cut-off, currently every Monday at 10am AEST. Orders placed after the cut-off for a given week will be combined in the following week’s batch where eligible. If you would like your orders kept separate, or have a question about whether your orders will be combined, please contact us before the relevant cut-off.
2.4 Postage and handling fees
Postage and handling fees are stated at checkout. These rates may change from time to time; the rate shown at checkout for your order will apply.
2.5 Delivery address
You are responsible for providing a complete and accurate delivery address at checkout. We are not responsible for delayed or failed delivery caused by incorrect or incomplete address details that you provided.
3. Receiving Your Order
3.1 Inspection window
Please open your package and check your Plant Material as soon as you receive it. If you have any concern about the condition, quality or identity of the Plant Material, you must notify us within 36 hours of delivery, with photographic evidence, so we can assess your claim. “Delivery” means the time the package is delivered to your address, or the time you are notified that it is ready for collection at your nearest Australia Post outlet, whichever happens first.
3.2 After the inspection window
Once the 36-hour inspection window has passed, responsibility for the storage, growing on and outcome of the Plant Material passes to you, except for any rights or remedies you have under the Australian Consumer Law that cannot be excluded.
3.3 Wrong variety or item received
If you receive a different variety or item to what you ordered, please contact us within the inspection window in clause 3.1 with photographic evidence. Depending on availability, we will offer a refund or a replacement of equivalent value. Because mislabelling of dahlias or chrysanthemums in particular is often not apparent until flowering, we will also consider claims made after flowering in good faith, though we may not always be able to verify or remedy these once a growing season has passed.
4. Storage, Growing and Survival
4.1 Storage
Tubers and corms should be stored in a cool, dry, dark and well-ventilated place if not planted immediately. We are not responsible for tubers or corms that dry out or rot due to storage conditions once they are in your care.
4.2 No guarantee of growing success
We take care to supply viable, healthy Plant Material, but we cannot guarantee that it will survive, grow on or flower once it is in your possession. Growing success depends on factors outside our control, including your care, planting conditions, soil, pests and weather, and we are not liable for crop failure caused by these factors.
4.3 Virus and disease
We take reasonable precautions to supply Plant Material that appears healthy and free of disease. However, some viruses and diseases can be latent and may not show symptoms at the time of sale, and plants can also become infected after they leave our care. We do not guarantee that Plant Material is or will remain free of viruses or disease, and we are not liable for the presence or later development of viruses or disease in Plant Material you have purchased.
5. Returns and Refunds
5.1 Change of mind
Please choose carefully - we do not offer a refund, exchange or cancellation for change of mind once an order is confirmed.
5.2 Damaged or incorrect Plant Material
Due to the perishable nature of Plant Material, we only accept returns where the item is damaged, faulty, or does not match its description, and you have notified us within the timeframe in clause 3.1. Where we accept a claim, we will offer a refund of the purchase price (and, where relevant, return shipping), or a replacement, at your choice subject to availability. Original postage and handling fees are not refundable.
5.3 Processing refunds
Approved refunds are processed to your original payment method, generally within 10 business days. If more than 15 business days have passed since approval and you have not received your refund, please contact us at hello@moonrisegrowers.com.au.
6. Your Consumer Rights
This Agreement applies in addition to, and does not limit or replace, any guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded, restricted or modified. You can read more about your rights under the ACL at accc.gov.au.
7. Governing Law
This Agreement is governed by the laws of Victoria, Australia, and any dispute arising from it is subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.
